Renunication of two Boghall mineral leases.

Dated 23rd June 1909

We the Pumpherston oil company limited incorporated under the companies acts 1860 to 1880 and 1883 and having our registered office formaly at number 24 St Vincent place Glasgow, now at 135 Buchanan Street there – consideraing that by lease dated the 29th day of January and 12th day of Febrary and registered in the book of council and session trhe 24th day of March, all in the year 1894, entered into between Captain James Henry Cowan, Royal Engineers on the one and first part and ourselves on the other and second part, the said James Henry Cowan let to us and our assignees or subtenants (but under the declaration and exclusion therein contained), all and whole the whole minerals, including inter alia the whole seams so far as not then worked by bituminous oil shales, and also of coal, but excluding limestone, in that part of the first party's lands and estate of Boghall in the parish of Bathgate and County of Linlithgow, delineated on the plan or sketch signed by the parties as relative to said lease (and which mineral field is in that part of the said estate of Boghall which lies to the south of the Edinburgh and Bathgate railway) and that for the space iof 271/2 years from and after the term of Whitsunday 1893, with periodical breaks ijn fovor of the leasees as therein mentioned: And also considering that by another lease dated the 10th and 24th days of November and 7th day of December all in the year 1896, amnd with warrant of registration thereon on our behalf recorded in the divisions of the general register of sasines applicable to the county of Linlithgow the 29th day of May 1897 entered into between the said James Henry Cowam then Major, Royal engineers, on the one and first part and ourselves on the other and second part, the said James Henry Cowan let to us and our assignees or subtenants, (but under the declaration and exclusion also therein contained) all and whole the whole minerals, including inter alia the whole seams so far as not then worked of bituminous oil shales and also of coal, but excluding limestone in that part of the first party's said lands and estate of Boghall lying to the north of the Edinburgh and Bathgate railway delineated on the plan or sketch signed by the parties as relative to said last mentioned lease, and that for the space of 31 years as from and after the term of Whitsyunday, 1894, with periodical breaks in favour of the leasees as therein mentioned: And further considering that we have worked the mineral fields so let to us by the asid leases from the commencement of the same respectively until the present time, and that with the intention of further developing the said fields we have arranged with the said James Henry Cowan for a consoldiation of the two leases before mentioned, and for a extension of the period of endurance thereof, and for certain other alterations on the terms and conditions of the same, . . .

Leases renounced as at Martinmas 1907

. . . and that for convenience it has accordingly been arranged that the said leases should be renounced by us as at the term of Martinmas 1907, for the purpose and to the effect that the said James Henry Cowan should grant in our favour a new lease of the whole mineral field embrace in the said leases, which he has agreed to do, and the terms of which lease have been adjusted and settled between us: Therefore we, the said company do hereby renounce to and in favour of the said James Henry Cowan, his heir and successors, the said two leases dated as aforesaid, and our whole right, title and interest present and future therein and to the mineral subjects and others thereby let and generally all claims, interest and advantage which we have or might pretend to in or under the said leases repsectively, and that as at the said term of Martinmas, 1907: but that only for the purpose and to the effect before mentioned: Provided always that the said James Henry Cowan by his acceptance hereof and in consideration of the granting of the said new lease as aforesaid discharges us of the whole rents and prestations incumbent upon us by the said leases hereby renounced as for the period ftom and after the said term of Martinmas 1907. from which term the said new lease will commence to run: In witness Whereof
